American Resort issues discussion.
(The Carpatia Resorts blog has been created for discussion of the Carpatia Resorts Romanian property development. It was brought to my attention here because the people behind it were also involved in the American Resort project. The only connection between this new project and the American Resort project is the above-mentioned developer team, Bonemma and Shivers. The broker indermediary, Kevin Stillmock, is not involved in Carpatia Resorts, and neither Bonemma nor Shivers were involved in any part of the financial arrangements of the American Resort reservation fees of £2500 each, which was the exclusive preserve of Kevin Stillmock.

Is anybody out there?
ReplyDeleteI have 2 reservations in the American Resort and despite numerous emails to Global Wealth Managers and Kevin Stillmock I am still awaiting the refund of my £5,000 deposit. I fileed in faxed and posted their refund document at the beginning of August and was promised my refund within 28 working days. This has long since expired and I am considering legal action against Global Wealth Managers and Kevin Stillmock to reclaim my money.
Is anyone else interested in going down this road?

ReplyDeleteThis "American Resort", what / where is it, anyway? Is it just a name for another Romanian project, or is it actually in the USA?
I have a unit and so do 200 other people. The prob is the emails have not got out like with CMR. American Resort was another project in Romania not far from CMR. It was suppose to launch before CMR but did not even get to launch stages as relations between GWM and the developer broke down at an early stage. Apparently GWM had started transferring some of our money which they have now lost but are willing to pay from an insurance fund. Any way we were given aloud of stories for a whole year eg the developer of CMR had taken over the plans and agreed to honour the reservations. They had named it Cold Mountain Ski lodge. Quite a few investors did get a refund in the early stages as we were given a lot of false hope and at that stage not many were asking for refunds. I gave up and requested a refund in Jan 2008
ReplyDeletesorry let my clarify- GWM claim to have started transfering our funds. To date ARC despite several requests have need seen hard proof of payment to that developer. Just print out of payment requests which could have been canceled!
ReplyDeleteI too have been told that people did receive refunds but I'm not sure on this really. I have been waiting one year now since I raised that I wanted a refund. I believe there are as many AR units as CMR. It seems the legal case in regards to CMR is much more advanced.
ReplyDeleteYes that's because GWM slipped up and gave out every ones email addresses by mistake so we have all been able to communicate. Before taking action in CMR we should ask ARC for all the details of American Resort investors. But really ARC should be putting something together for all clients not us having to do it our selves. Any action will be better in bigger numbers and also more cost effective. The situation with American Resort is the exact same.

I think that this is pretty cheeky when he owes so many people so much money.
I think the CMR clients have a long road ahead of them so we should not waste any more time. Ive been hearing next couple of weeks of Kevin since January with the same large amounts/ different currency excuses. Although since the last 6 weeks he has stop replying. Ideally one big case against GWM i say. But for that we need all other ART investor details which only ARC can provide and i dont think he will provide them until he knows what action we are about to take and against whom. I mean look at how much stick he has got on this blog he would be stupid to let more people in on the action. In my opinion ARC should be leading both attacks
ReplyDeleteThere are 649 investors in American Resort. I took detailed information to the FBI about this hoax and they said they have no jurisdiction. I went to the Romanian government. The development does not exist and no one there knows anything about this supposed development.

ReplyDeleteArc Property statement in relation to the American Resort and Global
Wealth Managers
As investors are aware, there have been various issues with the American Resort
Project and particularly in relation to the involvement of Global Wealth Managers
(GWM). Over the course of the last year Arc Property has made strenuous efforts to
resolve these matters and has been involved in lengthy negotiations with GWM with
a view to securing refunds for investors or the ability to proceed with the investment
in some form. These protracted negotiations culminated in late July 2008 when we
reached agreement on the text of a refund request form. This form was emailed to
clients by GWM in late July/early August 2008.
This form obliged GWM to make refund payments to investors within 28 days of
receiving the signed request form. To the best knowledge of Arc Property, GWM has
not made any refund payments to clients under the terms of this refund form. Three
months have now passed since this form was first issued to investors and it is with
deep disappointment that Arc Property notes that GWM, to date, has seemingly
failed to meet its obligations.
Arc Property has made considerable efforts to bring about a commercial resolution to
the current situation, and given GWM’s apparent failure to meets its obligations, we
now believe that it may be worth investors exploring other options, including legal
action against GWM.
In spring 2007 Arc Property agreed to work with Mr. Kevin Stillmock to promote the
American Resort, a ski resort project to be built by the US real estate developer
ARTeg Inc. and its Romanian subsidiary in the vicinity of Brasov, Romania. Mr.
Stillmock represented himself as a sales representative of ARTeg and Arc Property
entered into a cooperation agreement with Mr. Stillmock to offer the opportunity to
‘pre-reserve’ apartments in the American Resort. The cooperation agreement stated
he had a ‘legally binding contract’ with ARTeg that enabled him to offer for sale
apartments within the resort. As part of the due diligence process, Arc Property had
a telephone conversation with a director of ARTeg about the project and discussed in
general terms how Arc Property would be cooperating with Mr. Stillmock’s US
company GWM to offer apartments in the resort to our client database.
Investors who took up this offer ‘pre-reserved’ apartments by signing a tri-partite
‘pre-reservation’ contract with GWM and ARTeg. Arc Property invested in the project
on the same terms as the other investors, and paid GBP 25,000 to GWM to secure
the ‘pre-reservation’ rights to 10 apartments. Under the terms of the ‘prereservation’
contract, GWM was obliged to transfer the ‘pre-reservation’ fees to
ARTeg within 45 days of receipt.
In August 2007, Arc Property was contacted by a representative of ARTeg. He stated
that Mr. Stillmock did not have the right to offer apartments within the resort for sale
and did not have the authority to enter into agreements on behalf of ARTeg. These
comments were seemingly in direct contradiction with Arc Property’s agreement with
Mr. Stillmock and the ‘pre-reservation’ agreement itself which states that “the
Guardian [GWM] is the official sales intermediary for the project’. ARTeg also claimed
they had not received any funds from GWM.
The representative of ARTeg was clearly angry and accused Mr. Stillmock of
obtaining investor’s money under false pretences. He also made various threats
against the directors and staff of Arc Property. Arc Property promptly reported these
threats to the Metropolitan Police. Arc Property requested that ARTeg provided a
detailed written version of events from their perspective, but this was unfortunately
not forthcoming. The lack of a substantive response, the threatening language and
various unfounded statements meant that Arc Property was unclear to what extent
ARTeg’s accusations against Mr. Stillmock/GWM were accurate, if at all.
Arc Property immediately put the allegations to Mr. Stillmock and he denied any
improper action. He accepted that he had personally stamped the ‘pre-reservation’
agreements with the signature of a Director of ARTeg, but claimed that he did so
with ARTeg’s authorisation. In the weeks immediately prior to being contacted by
ARTeg, Mr. Stillmock had stated that his relationship with ARTeg was becoming
difficult and he suggested that the underlying motive behind these allegations was
that the project had run into problems meaning that ARTeg would not be able to
comply with the terms of the ‘pre-reservation’ agreement. As the launch of the
project and start of construction work had not commenced on time this, theory had
some logic.
Arc Property asked Mr. Stillmock to provide evidence that:
1. The investor funds had been transferred by GWM to ARTeg as per the terms
of the ‘pre-reservation’ contract.
2. Mr. Stillmock, or a representative of GWM, had the authority to sign the ‘prereservation’
contracts on behalf of ARTeg.
3. That GWM had a contract with ARTeg which enabled them to act as a sales
representative for the American Resort project.
In response to these requests, Mr. Stillmock was able to provide what appears to be
a print out of a payment order for USD 150,000 to ARTeg. Mr. Stillmock also
produced a number of emails which he claimed evidenced that GWM had a sales
relationship with ARTeg pertaining to the resort. He was unwilling to provide Arc
Property with a copy of GWM’s agency contract with ARTeg on the grounds that it
was commercially sensitive.
Mr. Stillmock proposed that, due to the breakdown in his relationship with ARTeg, it
may be advisable to rethink the investment and advised that he been in discussions
with a Norwegian development company, North Capital. North Capital had plans to
build a broadly similar project and was apparently willing to effectively provide free
‘pre-reservations’ (in the expectation that a reasonable percentage would convert
into purchases) to American Resort investors. Arc Property raised this proposal with
North Capital and confirmed the veracity of the offer. Arc Property was informed that
North Capital had identified a site for the project (‘Cold Mountain Ski Lodge’) and
was in the process of concluding the land acquisition.
Via Arc Property, GWM offered investors the opportunity to receive a full refund or
the option of awaiting further details on the ‘Cold Mountain Ski Lodge’ project. A
significant number of investors opted for the refund and between November 2007
and March 2008 approaching half the total number of investors requested and
received a full refund of their ‘pre-reservation fees’ from GWM. These payments were
made by GWM through a foreign exchange agent in the UK and as such Arc Property
has independent confirmation that these payments have indeed been made.
At this stage, Mr. Stillmock stated that GWM had issues with the wording of the
refund request form used to date and would not be able to honour further refund
requests made using this form. Consequently Arc Property was obliged to enter a
protracted negotiation process with GWM and its legal representative (this was
conducted within the overall framework of the similar process underway in relation to
the ‘Cold Mountain’ resort).
Finally, a mutually agreeable refund request form was arrived at in July 2008. This
form provided for GWM to make refunds within 28 days of receiving the completed
request form from the investor. As stated above, this form was emailed to investors
by GWM in later July/early August, but Arc Property is not aware of any investors
having a refund payment from GWM under the terms of this new refund form.
You may wish to note the following points;
1. Arc Property has a cooperation agreement signed by Mr. Stillmock that
confirms a ‘legally binding contract’ exists with ARTeg Inc. that enabled him
to offer for sale apartments within the American Resort.
2. The ‘pre-reservation agreement’ (article 4.4) states that ‘the Guardian [GWM]
represents that it is emboldened with the power to issue pre-reservations on
behalf of the Developer that have full legal effect and bind the Developer to
the terms of this contract’.
3. The ‘pre-reservation agreement’ (article 4.8) states that ‘the Reservation
Fees paid by the Potential Buyer to the Guardian [GWM] will be
transferred to the Developer with 15 days of the Notice Period expiring’.
The ‘Notice Period’ is a 30 day period commencing on the day the
Guardian [GWM] receives the Pre-Reservation Fees… (article 4.6).
4. Arc Property has a statement from Mr. Stillmock that states;
"That I Kevin Stillmock, in my capacity as Manager of Global Wealth Managers
LLC, have reviewed the information presented by Arc Property International
to Arc clients relating to the American Resort. And it is to the best of my
knowledge, an accurate description of the intended project and opportunity
presented, and that Arc Property presents this opportunity in good faith on
the basis of information provided by the Global Wealth Managers LLC. Arc
Property shall hereafter not be liable for any errors, misleading statements
contained in the marketing material or omissions from it."
5. Arc Property has advised GWM that it wishes to forfeit any rights to its 10
‘pre-reserved’ units and that GWM should use the ‘pre-reservation’ fees paid
(GBP 25,000) to contribute towards refunds of other investors.
Arc Property is currently liaising with a group of investors to assist them with
possible legal action against GWM in relation to the Cold Mountain Resort and it is
likely that any legal action in relation to American Resort can be coordinated in
conjunction with this group. The process is still at an early stage.
Arc Property has also recently written to ARTeg requesting a detailed version of
events from their perspective in the hope that with the passing of time they may
be more willing to cooperate.
Arc Property will continue to act in the best interests of investors in helping to
resolve these outstanding issues and we sincerely hope for a swift and
satisfactory conclusion.

Arc property are in the process of being liquidated as they have failed as a business and failed their investors.
Currently GWM and its executive(s) Kevin Stillmock are still delaying refunds for the cold mountain project.
Seems both parties should have remembered the old adages - the customer is always right, and you never get a second chance to make a first impression
Just caught up with this blog. The only way I got my five deposits returned in the American Resort Project in January 2008 was to embarrass Kevin Stillmock in front of his new Norwegian associates (North Capital) and threaten a full forensic accounting investigation involving all his associates in Romania through Deloitte, Touche, Tohmatsu in Bucharest. This appeared to produce my refund fairly quickly. Also discovered that the elusive Kevin is only in his twenties. Best of luck to anyone still chasing this little pr**k. Go for the jugular!!

ReplyDeleteWe have also invested in the American Transylvania through Kevin Stillmock and paid our deposit only for him to disappear and never get in touch again. We never got e mailed any refund forms. In fact we could not get any contact with them once we paid our deposit. Would love to know if there is realistically any chance of getting our deposit back. Anybody who knows anything please let us know. Cheers.

I have no knowledge of, nor involvement in, Carpatia Resorts. This makes it impossible for me to judge what is fact and what is not. I'm hearing two sides and I have no way to know what is true and what is not.

ReplyDeleteI am an investor in Carpatia/American resorts. Brian Bonnema did acknowledge that they received my money from Keven Stilnoct. I have however not received any updates lately. Can anybody update me on the latest status and next steps. Maybe all the investors should stick together to obtain more clarity on the investments.
I still have the voice recordings when Brian and Kevin promoted American Resorts. I therefore don't understand this statement. I don't understand this statement from Btrian and King John at all, because I have Brian's American Resort voice recording. As an fyi, this is not Jim who posted that post, as much as you may want it to be. I get it that people lost money, however, I find it unbelievable that people have nothing better to do than to sit and write nasty comments about others. In case all of you are unaware, millions of people have lost millions of dollars over the past few years during this recession. These things happen. Suck as they may, they still happen. Sitting and writing nasty things about them is completely non-productive. It should be a learning lesson for the next time.

If you start pushing my buttons I'll likely decide that reasonable protocols should not be observed, and since these blogs all have good Google weight that would not be to your advantage. ReplyDeleteI think it may be time to shut this down, delete this blog and move on. I lost money on this opportunity and it sucks that it didn't work out but life is too short. It was a painful and costly lesson and picking at the scar isn't going to help. I get and understand the frustration and anger but from what I've learned nothing short of a miracle is going to get anyone any money back.
